Introduction:

By accessing or using the services provided by Only Option Media, you agree to comply with and be bound by these terms and conditions.

Service Delivery & Project Management

a. All projects begin with a consultation to determine scope, deliverables, and timeline

b. Clients will receive a detailed proposal outlining services, costs, and projected completion dates

c. Regular updates and progress reports will be provided throughout the project lifecycle

Deposits and Payments

a. All website projects require a 50% deposit before any work commences. This deposit is non-refundable.

b. The remaining 50% is due upon completion of the project, before the website is made live or handed over to the client.

c. Failure to pay the remaining balance upon completion may result in delays in the launch or release of the website.

Non-Refundable Deposit

a. The 50% deposit is non-refundable under any circumstances. This policy ensures that Only Option Media is compensated for the time, effort, and resources dedicated to each project.

b. In the event of project cancellation by the client, the deposit will be forfeited.

Project Timelines

a. Only Option Media will provide an estimated timeline for each project phase

b. Timelines may vary based on project complexity and client responsiveness

c. Clients must provide necessary access, content, and approvals within agreed timeframes

Intellectual Property

a. Upon full payment, the client will own the rights to the completed website. Only Option Media retains the right to showcase the project in our portfolio unless otherwise agreed upon.

b. Any content, graphics, or materials provided by the client must not infringe on any third-party rights.

Limitation of Liability

Only Option Media will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our services, even if we have been advised of the possibility of such damages.

Termination

a. Only Option Media reserves the right to terminate any project at our discretion. In such cases, we will provide a pro-rata refund of any payments made beyond the non-refundable deposit.

b. Clients may terminate the project at any time, but the 50% deposit will not be refunded.

Governing Law

These Terms are governed by and construed in accordance with the laws of Louisiana where Only Option Media is headquartered, without regard to its conflict of law principles.

Service Level Agreements

a. Response times for various service categories will be specified in individual service agreements

b. Emergency IT support availability and terms will be outlined in relevant service contracts

c. Website uptime guarantees and hosting specifications will be detailed in hosting agreements

Maintenance & Support

a. Ongoing maintenance packages are available for websites and IT systems

b. Support hours and response times vary by service level

c. Emergency support services may incur additional charges

IT Support

a. Emergency IT support is available 7 days a week for qualified clients within our service area.

b. Service Area & Response Time

  • Same-day, in-person emergency support is guaranteed for clients within a 30-mile radius of our office location
  • Response times and availability for clients outside this radius will be evaluated on a case-by-case basis
  • Virtual support options may be available regardless of location
Emergency Service Qualification
  • Client must have an active service agreement
  • Issue must significantly impact business operations
  • Service address must be within the specified service radius
  • Safe access to the premises must be provided
Emergency Support Rates
  • Emergency service calls may incur premium rates
  • After-hours, weekend, and holiday services are subject to additional fees
  • Travel fees may apply based on distance and circumstances
  • Rates will be clearly communicated before service is rendered
